Terms and conditions
Preamble
The present "General Terms and Conditions of Sale" apply to legal transactions relating to products sold to customers by L'Autre Thé Sarl within its virtual store.
DEFINITIONS :
The following words or expressions shall have the following meanings:
Internet shop: means the website of L'Autre Thé Sarl on which the Products are presented and sold to customers.
Order: means the contract of sale concluded between L'Autre Thé Sarl and the customer of the Internet shop of L'Autre Thé Sarl.
Product sheet: refers to the classified information concerning a product provided by L'Autre Thé Sarl during the sale of the said product in its internet shop.
Products: means all the goods and services offered for sale by L'Autre Thé Sarl in its internet shop.
Service: means the sale of Products by L'Autre Thé Sarl to customers of its Internet shop.
Transaction: refers to all operations, secure processing, authorizations and agreements relating to the payment of the price of Products ordered by credit card.
ARTICLE 1: OBJECT
The purpose of these General Terms and Conditions of Sale is to define the terms and conditions to which L'Autre Thé Sarl offers and sells its Products to its customers. These general conditions of sale will prevail over all other conditions contained in any other document, except prior, express and written waiver.
ARTICLE 2 - ACCEPTANCE OF CONDITIONS
The customer acknowledges having read, at the time of placing an Order, these terms and conditions of sale and expressly accept them without reservation. These general conditions of sale govern the contractual relationship between L'Autre Thé Sarl and its client, both parties accepting them without reservation.
ARTICLE 3 - PRODUCTS
The majority of products offered by L'Autre Thé Sarl to its customers are immediately available. However, all products marketed by L'Autre Thé Sarl may or may not be sold online.
ARTICLE 4 - ORDER
Automatic registration systems are considered to be proof of the nature, content and date of the Order.
L'Autre Thé Sarl will confirm to the customer the acceptance of the Order by sending a confirmation message to the email address that the latter has communicated. The sale will be concluded only from the sending of said order confirmation.
L'Autre Thé Sarl reserves the right to refuse or cancel any Order from a customer, particularly in the event of insolvency of said customer or in the event of a failure to pay the Order concerned or a previous delivery. or a dispute over the payment of a previous order.
The particulars indicated by the customer, when entering the information inherent to his Order engage him. L'Autre Thé Sarl can not be held responsible for errors committed by the customer in the wording of the address of the recipient of the Order (delivery address, billing address in particular) and delays in delivery or inability to deliver the Products. ordered that these errors could spawn.
ARTICLE 5 - DELIVERY
After confirmation of the Order and subject to payment of the price of the ordered products, L'Autre Thé Sarl undertakes to send to its customer the products ordered at the delivery address within 5 days.
All Products stipulated in the Orders placed at L'Autre Thé Sarl are intended for the personal use of the customers or the recipients whose name is mentioned at the delivery address.
In this case, the customer agrees to settle upon receipt, all taxes, duties, taxes and other charges present and future due in respect of the delivery of said products themselves; the joint and several liability of L'Autre Thé Sarl can not at any time be engaged in this respect.
The customers or the recipients of the Products are prohibited any partial or total resale of the Products.
Delivery will be made by LA POSTE.
The delivery charges are 5.90 €
In case of late delivery exceeding seven (7) days, the Customer may, if he wishes, and except in cases of force majeure, terminate the sales contract by registered letter with acknowledgment of receipt. This right must, however, be exercised within sixty (60) working days from the date of delivery initially provided for in the contract.
Upon receipt of the ordered Products, the customer or the recipient will have to check the proper functioning of the delivered goods, and will be aware of its conditions of use appearing on the instructions for use which is provided.
In the event that one or more of the Products ordered are missing or damaged, the customer or the recipient must make any reservations to LA POSTE at the time of delivery.
In case of apparent defects, the customer has the right of return under the conditions provided in the instructions for use of the property.
For reasons of availability of the Products ordered, an Order may be the subject of several successive deliveries to the customer.
In the event that the customer would like the Products ordered to be delivered to two different addresses, it will be necessary for the latter to pass 2 separate Orders.
ARTICLE 6 - RETRACTION
The customer has a period of 7 days from receipt of the Products ordered to return to L'Autre Thé Sarl for exchange or refund. In this case, the customer will have to return the new products, intact, accompanied by all possible accessories, instructions for use and documentation to the following address:

In case of exercise of the right of withdrawal, L'Autre Thé Sarl undertakes to refund the sums paid by the customer, free of charge, with the exception of the cost of return.
The refund is due within a maximum of 14 days.
ARTICLE 7 - PRICE
The price is expressed in euro.
The price indicated on the Product Sheets does not include the costs inherent to the transport.
The price indicated in the order confirmation is the final price expressed all taxes including VAT. This price includes the price of the Products, the costs of handling, packaging and storage of the Products, transportation and commissioning costs.
ARTICLE 8 - PAYMENT
The price charged to the customer is the price indicated on the order confirmation sent by L'Autre Thé Sarl.
The price of the Products is payable in cash by one of the means of payment offered on the site on the day of the actual order.
The Order validated by the customer will only be considered effective when the secure bank payment center has given its agreement on the transaction and, if applicable, after acceptance of the assumption of responsibility of the risk by the insurer.
ARTICLE 9 - APPLICABLE LAW
These general conditions of sale are subject to French law.
ARTICLE 10 - RESPONSIBILITY
L'Autre Thé Sarl can not be held responsible for damage of any kind, whether tangible or intangible, which could result from a malfunction or misuse of the Products marketed.
The responsibility of L'Autre Thé Sarl will, in any case, be limited to the amount of the order. In case of difficulties in the application of this contract, the customer and L'Autre Thé Sarl reserve the possibility, before any action in court, to seek an amicable solution.
Otherwise, for business customers, the Commercial Court of Paris is the only competent, regardless of the place of delivery and the method of payment accepted.
ARTICLE 11 - GUARANTEE
In any case L'Autre Thé Sarl can not be held responsible for non-compliance with the regulations and laws in force in the country of receipt. The responsibility of L'Autre Thé Sarl is systematically limited to the value of the Product involved determined at the date of sale and this without recourse to the brand or the company producing the product.

ARTICLES 12 - LEGAL NOTICE
The information of the personal information collected for the purposes of the distance selling is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee. The lack of information leads to the non-validation of the Order.
In accordance with the law "Informatique et Libertés", the processing of personal information relating to customers has been declared to the Commission Nationale Informatique et Libertés (CNIL).
The customer has (Article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him, which he can exercise with Store Factory. In addition, L'Autre Thé Sarl undertakes not to communicate, free of charge or in return, the details of its customers to a third party.
